Within the core practice areas of utility regulation and administrative law, Mr. Gray provides strategic advice and counsel to a wide range of clients regarding matters before the Federal Energy Regulatory Commission (FERC), state public utility commissions, state courts, federal courts, and legislative bodies. Applying his vast experience in regulation, business, and government affairs, Mr. Gray strives to be a trusted resource to his clients. He achieves that goal by maintaining his commitments to providing personal attention to his clients and developing innovative strategies and solutions that frame the issues in a light most favorable to his clients’ objectives.

Mr. Gray has particular experience guiding clients through litigation, having served as lead counsel in litigated proceedings involving electric rates and tariffs, gas rates and tariffs, and utility mergers. Working closely with clients and technical consultants, Mr. Gray has a reputation for successfully establishing overall case strategies and implementing those strategies through motions practice, the development of testimony, discovery, cross-examining and defending witnesses, and briefing. Beyond his distinguished track record in utility-related litigation, Mr. Gray also focuses on representing clients in all phases of appeals of agency decisions. He has represented clients in appeals before the United States Court of Appeals for the District of Columbia and Ninth Circuits, as well as the District of Columbia Court of Appeals.

In addition to his experience in litigation and appellate matters, Mr. Gray is regularly called upon to advise clients with respect to rulemaking proceedings and policy matters, legislation, Regional Transmission Organization/Independent System Operator stakeholder processes, matters involving Hinshaw and section 311 pipelines, compliance and enforcement matters, formal and informal settlement negotiations, transactional matters, complaints, matters involving the Public Utility Regulatory Policies Act, and the development of energy projects. On a pro bono basis, Mr. Gray represents residential and low-income customers in disputes with local utilities.

Prior to joining Duncan & Allen in 2018, Mr. Gray was a partner at Duncan, Weinberg, Genzer & Pembroke, P.C.—Washington, DC-based law firm that he joined in 2008. Upon graduating law school in 2006, through 2008, Mr. Gray served as Assistant General Counsel and Litigation Counsel to the Kansas Corporation Commission (KCC). There, he represented the KCC before FERC and managed outside counsel, advised the KCC’s representative to the Southwest Power Pool’s Regional State Committee, appeared before the Kansas Legislature and various Kansas district courts, and assisted with appeals to the Kansas Court of Appeals. He also represented the KCC’s technical staff in regulatory proceedings involving (i) utility mergers, (ii) electric, gas, and water rate cases, (iii) enforcement proceedings involving motor carriers and the Kansas Underground Utility Damage Prevention Act, and (iv) certificate proceedings involving intrastate pipelines.
